It is argued by the learned counsel for the applicant that the first information report has been lodged on 10th December, 2018 by Chandrasen i.e. father of the victim, namely, Kumari Bharti against one named accused i.e. the applicant alleging therein that on 9th December, 2018 at 1500 hours the victim went to market for purchasing some goods, after some time when she did not return, the informant tried to search for her and during search, he has been informed by Barber, namely, Ajay Kumar that he had seen the victim along with the applicant sitting in a Tempo. Therefore, the informant was sure that the victim was enticed away by the applicant for which the present first information report has been lodged. The victim has been recovered safely and her statement under Section 161 Cr.P.C. has been recorded, wherein she has stated that when she went to market, on the way the applicant met her and took her forcefully along with him saying that he will marry her. For one-two days they were visited here and there. When they reached the railway station to go somewhere, the Police caught them.Sonu had a barber shop opposite the house of victim and she knew him. The applicant has not committed any indecent act with her. In the statement recorded under Section 164 Cr.P.C., the victim has stated that when she went to market, on the way the applicant met her and said to her to go along with him but when she refused, he took her forcefully by catching her hand. She had not raised any alarm as many persons were standing there. The applicant has not kidnapped her. She visited along with him here and there.
