It is argued by the learned counsel for the applicants that for the alleged incident dated 21st March, 2019, the present first information report has been lodged by Vasudeo Chaudhary on 23rd March, 2019 against four named accused and four to five unknown accused persons including the present applicants i.e. after two days from the date of alleged incident for which no plausible explanation has been given, which makes the prosecution case doubtful. In the first information report, it has been alleged that on 21st March, 2019 between 02:30 to 03:00 p.m. when the younger son of the informant, namely, Vijay Kumar Yadav after playing Holi was coming to home, then on the way, all the accused persons, who were in drunken condition, started demanding money for purchasing liquor, when he refused to give the same, all the accused persons started abusing and beating him, then Vijay Kumar Yadav said to them that for the said incident, he would lodge a first information report against them, then all the accused persons again started beating him by lathi, stick and iron rod due to which he sustained injuries and became unconscious. Thereafter they ran away. It has further been argued by the learned counsel for the applicants that in the statement recorded under Section 161 Cr.P.C., Badal and Arvind along with 6-7 unknown persons have beaten him due to which he sustained serious injuries. In the first information report as well as in the statement of the injured, general role of causing injuries to the injured has been assigned to all the accused persons. No specific role as to who is the author of the injuries caused to the injured has been assigned to any of the accused persons. It has further been argued by the learned counsel for the applicants that earlier due to election dispute, a quarrel took place between the applicants' family and informant's family and because of aforesaid enmity the present first information report has been lodged falsely implicating the applicants.
