It is argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case due to ulterior motive. It is next argued that as per allegation in the FIR on 27.10.2018 at about 3.30 hours when the informant's mother, father and brother had gone to work in the fields, the applicant whose field is just beside that of the informant, due to some property dispute, started quarreling with the aforesaid persons and after exhortation to kill them the applicant hit mother of the informant by axe, due to which she sustained injuries. It is argued that though in the statement of the injured the prosecution story has been supported, but the role of causing injury has been assigned to both the accused persons. As per injury report, the injuries are caused by hard and blunt object. A report was also called from the State regarding x-ray done and it has been submitted that no x-ray has been conducted. It has been argued that there was no motive or intention to kill the the injured and the incident took place due to some quarrel between the parties. Learned counsel has also pressed this bail application on the ground of detention as the applicant is languishing in jail since 29.10.2018. It is next contended that the applicant has no criminal history and there is no possibility of fleeing away from the judicial process or tampering with the witnesses and in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. Accordingly, he requests for bail.
