Heard Mr. Pushpendra Singh, learned counsel for the applicant, the learned A.G.A. for the State and Mr. Ashutosh Kumar Pandey, Advocate, holding brief of Mr. Vinod Singh, learned counsel for the complainant.
The first bail application of the applicant was rejected by this Court, vide order dated 28.11.2018. The Court observed in the order dated 28.11.2018 that the Trial Court shall gear up the trial and conclude the same within a period of six months from the date of production of a certified copy of this order. It is urged by learned counsel for the applicant that as the trial has not been concluded within a period of six months, the applicant be released on bail.
Having perused the order sheet of the case pending before the Court below, it cannot be said that the delay in disposal of the case has been caused on the account of slackness on the part of the Court below. No other new ground has been raised in this second bail application.
The bail application is, accordingly, rejected.
