Heard learned counsel for the petitioners; and the learned Standing Counsel for the respondents 1 to 3.
This petition has been filed for a direction upon the respondents to consider allotment of the petitioner institution as an Examination Centre in the forthcoming Board Examinations, 2018 or to allot some other centre for the students enrolled in the petitioners' institution.
The learned Standing Counsel who appears for the Board has submitted that list of examination centres was finalized after inviting objections and now it may not be possible to make a last minute change inasmuch as Board exams are to commence from 01st week of February, 2018.
Admittedly, before finalizing the list of examination centres, a provisional list was published and thereafter a final list was published by meeting out objection taken to the provisional list. The final list of examination centres has not been challenged in this petition. Although averments have been made against inclusion of few institutions in the final list but those institutions have not been made party respondents in the present petition.
Since the Board Examinations are to commence from the first week of February, 2018, it is too late in the day to consider the prayer of the petitioner, more so, when there is no challenge to the final list of examination centres published by the Board. The petition is dismissed . Dismissal of this petition is without prejudice to the right of the petitioners to represent their cause before the Board.
