Heard learned counsel for the petitioner and Sri Mangla Prasad Rai for the respondents-University.

The present petition has been filed for direction upon the fifth respondent to permit the petitioner to appear in 5th semester examination commencing from 9th January, 2018.

In paragraph 10 of the petition it is stated that due to unavoidable circumstances "illness", the petitioner could not complete the minimum requirement of 75% of the attendance, therefore he has been denied Admit Card for the forthcoming examination.

It is not known whether shortage of attendance on medical ground can be condoned or not.

¶9

Under the circumstances, this Court considers it appropriate to give liberty to the petitioner to represent his cause to the fourth respondent (Examination Controller, Chaudhary Charan Singh University, Meerut). If any such representation is filed within three days from today along with certified copy of this order, the fourth respondent shall call for attendance details of the petitioner from the fifth respondent and shall take appropriate decision in accordance with law, within forty eight hours from the date of filing of such representation.

It is made clear that this Court has not expressed any opinion of merits of claim of the petitioner.

With the aforesaid liberty and directions, the petition stands disposed of.

Let a copy of this order be supplied to learned counsel for the petitioner today.
