Heard learned counsel for the petitioners; learned Standing Counsel for respondents 1, 3 and 4 and perused the record.

The case of the petitioners is that in the past the petitioner's institution had been appointed examination centre for the Board examinations and for the forthcoming examination it was included in the provisional list of examination centres but has been arbitrarily removed from the list which was finally published.

On the averments made in the petition, this Court had directed the learned Standing Counsel to seek instructions.

Written instructions have been obtained by learned Standing Counsel from the District Inspector of Schools, Mau and they have been supplied to the Court.

From the written instructions as also the order of Up-Ziladhikari, Madhuban, Mau, dated 26th July, 2017, supplied along with the written instructions, it appears that there is some dispute as regards the land on which the petitioner's institution has been established. Apart from that at the time of inspection it was discovered that furniture in the institution was not present and was allegedly sent to the Degree college for May, 2017 examinations.

It is well settled that no institution can claim as of right to be appointed an examination centre. Further, the learned Standing Counsel has informed the Court that Board Examinations are to commence from first week of February, 2018 and since examination centres have been finalized much earlier, a change would create a lot of problems, at this stage.

Under the circumstances, as the examinations of the Board are to commence from 1st February, 2018, this Court does not find it appropriate to interfere in the allotment of examination centre, at this stage. The petition is, accordingly, disposed of with liberty to the petitioners to ventilate their grievance in the next Board examination. In case the petitioner's institution has been debarred from being appointed examination centre, it shall have liberty to pursue appropriate remedy against such order of debarment.
