Pursuant to the order dated 08.01.2018, learned Standing Counsel has obtained instructions and on the basis of the written instructions has informed the Court that there were two institutions shortlisted for being appointed as Examination Centre. Both were located at distance of 1 Km from each other. It has been submitted that other institution Azad Memorial Inter College, Jagdishpur, which has been finally appointed as Examination Centre, was higher in quality point marks and therefore a decision was taken to appoint the same as an Examination Centre.
Learned Standing Counsel has also informed the Court that Board Examinations are to commence from first week of February, 2018 and as examination centres have already been finalized, it would be very difficult to change examination centres at this belated stage.
As no institution can claim as of right for being appointed as an Examination Centre, this Court does not find it appropriate to entertain this petition at this stage and create complications for the Board. The petition is accordingly disposed of with liberty to the petitioner to stake claim in the next Board Examination in accordance with law at the appropriate stage.
