Pursuant to the order dated 08.01.2018, learned Standing Counsel has obtained instructions and has informed the Court that in the Board Examination of the year 2016, upon surprise inspection of the Examination Centre, the Examination Centre Incharge was found not discharging his duties properly and, accordingly, the Examination Centre Superintendent was changed. Thereafter, a report dated 03.05.2016 was submitted by the District Magistrate not to appoint it as examination centre. Keeping all this in mind, the District Level Committee took decision not to make it examination centre and, in fact, it was not made examination centre in 2017 Board Examination also.

Learned Standing Counsel has also informed the Court that Board Examinations are to commence from first week of February, 2018 and as examination centres have already been finalized, it would be very difficult to change examination centres at this belated stage.

As no institution can claim as of right for being appointed as an Examination Centre, this Court does not find it appropriate to entertain this petition at this stage and create complications for the Board. The petition is accordingly disposed of with liberty to the petitioner to stake claim in the next Board Examination in accordance with law at the appropriate stage.
