Heard learned counsel for the petitioner and learned Standing Counsel for respondents 1 to 6.

The prayer made in this petition is for direction upon the respondents to consider and decide the application of the petitioner in respect of seeking recognition to the petitioner's institution for high school.

Learned Standing Counsel states that decision in that regard shall be taken by the respondent no.3 (Secretary, Madhyamik Shiksha Parishad, U.P., Allahabad).

In view of above, this petition is disposed of with liberty to the petitioner to make a comprehensive representation before the respondent no.3 annexing therewith all the relevant documents including application submitted earlier for recognition. If any such representation is filed along with relevant documents including application submitted earlier, the third respondent shall consider the claim of the petitioner and take appropriate decision after calling report from the authorities concerned, in accordance with law, preferably, within a period of three months from the date of filing representation in his office. It is made clear that this Court has not expressed any opinion on merits of claim of the petitioner.

With the aforesaid liberty, the petition is disposed of.
