This petition has been filed with two prayers. The first is to quash the order dated 16.08.2014 passed by the Deputy Registrar, Agra by which registration of the Society has been cancelled in exercise of power under Section 12-D of the Societies Registration Act. The second prayer is for a direction upon the Divisional Commissioner to decide an appeal alleged to be pending against the order dated 16.08.2014.

It is the case of the petitioners that against the order dated 16.08.2014, an appeal has been filed which is numbered 07 (07/C201618001464) and is pending before the Divisional Commissioner, Aligarh Division, Aligarh.

Considering the facts of the case,without expressing any opinion on the merits of the claim of the petitioners, this petition is disposed of by giving liberty to the petitioners to move an application before the Divisional Commissioner, Aligarh Division, Aligarh before whom the appeal is allegedly pending to expedite proceeding of the appeal by annexing documents to show that the appeal has been filed. If any such application is filed, the Divisional Commissioner, Aligarh Region, Aligarh shall verify from the record whether appeal has been filed and is pending or not. If it is found pending, he shall endeavour to decide the appeal within a period of three months from the date of filing of such application along with certified copy of this order.
