Heard Sri Ashok Kumar Lal holding brief of Sri Uday Pratap Singh, learned counsel for the petitioner, Sri Narendra Kumar Giri, learned counsel for the respondents no.3 & 4 and the learned standing counsel for the respondents no.1 & 2.

The petitioner in the writ petition is seeking quashing of the recovery citation dated 17.09.2018 for recovery of Rs.4,82,500/-.

According to the petitioner, she had taken a loan of Rs.2,20,000/- from the respondent-bank for development of Mango garden but she could not pay off the same. It is stated that she has already deposited a sum of Rs.1,05,000 on 18.03.2010, Rs.20,000/- on 24.02.2012 and Rs.50,000/on 08.01.2015. She further states that she is ready and willing to make payment of the entire loan amount provided the respondent-bank gives her the statement of account and also fixs a certain time limit within which she has to pay the entire loan amount.

No useful purpose would be served by keeping this writ petition pending.

The writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction that if the petitioner prefers a fresh representation before the respondent no.3, Branch Manager, U.P. Shakari Gram Vikas Bank Ltd. Branch Nagina, District Bijnor raising all her grievances as raised in the present writ petition within a period of one week from today alongwith the certified copy of this order, the respondent no.3 shall provide her statement of account within a further period of one week also informing her the time period within which she is required to deposit the remaining loan amount.

Till such decision is taken by the respondent no.3 no coercive steps will be taken against the petitioner in respect of the recovery citation dated 17.09.2018.
