The present petition has been filed challenging a notification dated 30.12.2017 issued by the Authorised Controller for holding of election of the Committee of Management of Shiv Pratap Singh Inter College, Pawari Kalan, District Mirzapur.
It is the case of the petitioners that the election notification dated 30.12.2017 was made pursuant to the order dated 23.01.2017 passed by the Joint Director of Education, Vindhyachal Region, Mirzapur and the said order was challenged in Writ C No. 5790 of 2017 in which an interim order was passed on 08.02.2017 staying the effect and operation of the order dated 23.01.2017 therefore holding of election was in the teeth of the interim order passed by this Court.
Sri G.K. Singh, learned senior counsel, who appears on behalf of the petitioners, on the basis of the instructions received by him, has produced an order dated 09.01.2018 issued by the District Inspector of Schools, Mirzapur thereby directing the Authorised Controller to stop the election process on account of the interim order passed by this Court in Writ C No. 5790 of 2017 and he has also produced an order dated 10.01.2018 passed by the Authorised Controller cancelling the election.
In view of the aforesaid orders, which have been produced by the learned counsel for the petitioners, the cause for maintaining this petition no longer survives and, therefore, this petition has been rendered infructuous. In case, the parties have any grievance against the aforesaid orders dated 09.01.2018 and 10.01.2018 or against any further action taken by the authorities, the parties shall be at liberty to file a petition in that regard.
Subject to above, the petition is dismissed as infructuous .
