Heard learned counsel for the petitioner and learned Standing Counsel for the State.

The present writ petition is directed against the communication letter dated 12.3.2018 of the respondent no.4, whereby recommendation of the claim of the petitioner for grant of benefit of "Mukhya Mantri Kisan & Sarva Hit Beema Yojna' has been refused by respondent no.4 on the ground that the deceased was unmarried son of the petitioner and he was not the 'Karta' of the family.

The written instructions supplied by the learned Standing Counsel pursuant to the direction issued by this Court, only narrates the requirements of the scheme which categorically provides that the dependent parents of an unmarried male would be entitled to the benefit of the scheme in question.

The petitioner claims to be the widowed mother of the deceased, who was younger son of the petitioner. It is contended that the petitioner was solely dependent upon the deceased and she has no other source of income. This aspect appears to have not been examined by the respondents.

In view of the above, the present writ petition is being disposed of with the following directions:-

(i) The petitioner shall move a fresh application before the respondent no.2 for grant of benefit of the scheme in question, along with certified copy of this order.

(ii) The said application shall be examined by the respondent no.2 in the light of the procedure provided under the scheme in question.

For the purpose, fresh recommendation of the respondent no.4 shall be invited for considering the claim of the petitioner that she was dependent widowed mother of the deceased.

The respondent no.2 shall be under obligation to take a fresh decision in the matter within a period of two months from the date of submission of the application by the petitioner, by passing a reasoned and speaking order in accordance with the scheme in question.
