The instant writ petition is directed against the order dated 2.2.2018 passed by the Assistant Registrar, Gorakhpur whereby, he has finalised the Electoral College comprising of 45 members for conducting election of the Committee of Management of Chandra Shekhar Azad Vidyalaya, Devgaon, Gauri Bazar, Deoria, a registered Society under the Societies Registration Act, 1860. The election is to be held by the Assistant Registrar in exercise of power under Section 25(2) of the Act. The petitioners are aggrieved by the part of the order, whereby claim of membership of the persons from Serial No. 45 to Serial No. 70 in the list of 72 persons, supplied by petitioner No. 2, has been repelled. The order records that the petitioners have failed to produce documentary evidence to prove their induction, as valid members. It has also been specifically recorded in the impugned order that name of these persons does not find place in the membership register. There is a further finding to the effect that receipts relating to deposit of subscription fee is in the name of Chandra Shekhar Azad Inter College, whereas, the name of the Society is Chandra Shekhar Azad Vidyalaya. The amount of subscription fee deposited by the receipts produced before the second respondent is also at variance with the amount contemplated under the byelaws. It has also been observed that a Civil Suit bearing No. 182/1997 relating to membership dispute has been dismissed by judgment dated 23.7.2014.
