Heard learned counsel for the petitioner; learned Additional Chief Standing Counsel appearing for the State respondents.

With the consent of parties, without issuing notice to the fourth and fifth respondents, the present Writ Petition is being finally heard and decided.

By means of present writ petition, petitioner seeks a direction commanding the Regional Selection Committee headed by the Joint Direction of Education Azamgarh Region Azamgarh, to consider the candidature of petitioner for promotion to the post of Lecturer in English Subject before finalization of the claim set up by the Committee of Management in favour of fifth respondent.

It has been apprised to the Court that for promotion on the post of Lecturer, the Committee of Management of the Institution namely Murali Manohar Town Inter College, Ballia on 14.04.2017 has made recommendations wherein the name of petitioner does not at all finds place and aggrieved with the same petitioner has approached to the Regional Selection Committee headed by Joint Director of Education, Azamgarh Region, Azamgarh on 11.01.2018 and 26.02.2018 but the same is still pending Consideration.

Learned Additional Chief Standing Counsel very fairly submits that before taking any final decision on the recommendation made by the Committee of Management, the Authority concerned shall consider the claim of the petitioner also.

In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the Writ Petition is disposed of asking the Joint Direction of Education Azamgarh Region Azamgarh to take a final call in the matter on the basis of recommendations made by the Committee of Management of the Institution concerned made preferably within a period of two months from the date of production of certified copy of this order but certainly after considering the case of the petitioner also.
