Heard learned counsel for the parties.

The petitioner is before this Court with request to issue direction to the respondents to release his monthly salary & other consequential benefit and also make payment of arrears of salary from 9.8.2010.

Learned counsel for the petitioner states that the petitioner has already filed a representation dated 30.11.2017 before the fourth respondent i.e. District Basic Education Officer, Ballia for redressal of his grievance, which is still pending. He has confined his prayer only to the relief that his representation dated30.11.2017 may be considered by the appropriate authority.

Shri Sanjay Chaturvedi, learned counsel for the fourth respondent has no objection to the said prayer.

No useful purpose would be served in keeping the writ petition pending.

In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the District Basic Education Officer, Ballia to decide the petitioner's representation in accordance with law, taking into account the enquiry report dated 25.3.2014 (Annended as Annexure No.6 to the writ petition) within a period of two months from the date of production of a certified copy of this order before him.
