Learned counsel for the petitioner is permitted to implead Principal, District Institute of Education and Training, Mirzapur and Secretary, Examination Regulatory Authority, Allahabad as fourth and fifth respondents.

Heard Shri Seemant Singh, learned counsel for the petitioner, learned Additional Chief Standing Counsel for the State respondents, Shri Jay Ram Pandey, Advocate has entered appearance on behalf of second and third respondents.

Petitioner is before this Court with the request to direct the Principal, District Institute of Education and Training, Mirzapur to forward the name of petitioner before Secretary, Examination Regulatory Authority, Allahabad, who has completed 6 months training in Elementary Education Training Programme after issuance of the appointment order on the post of Trainee Teacher/ Assistant Teacher. Further prayer has been made that direction may be issued to the Secretary, Examination Regulatory Authority, Allahabad to conduct Trainee Teacher Selection Examination 2011 in respect of the petitioner and to issue pass certificate in case the petitioner is declared pass in the examination so that the petitioner may be issued appointment order on substantive post of Assistant Teacher in Primary Schools (Junior Basic School) in district Mirzapur, within stipulated period.

Learned Counsel for the petitioner submits that in similar circumstances the Court has already accorded leave to the petitioner in Writ A no.1084 of 2018 (Dinesh Kumar Pandey vs. State of U.P. and others) to move detailed representation before the authority concerned and also directed to decide the claim set up by the petitioner in the light of the judgement passed in Neeraj Kumar Rai and others vs. State of U.P. and others and as such request has been made that the claim set up by the petitioner is liable to be redress in the same terms.

Learned Additional Chief Standing Counsel has not at all opposed the said prayer.

Without adverting on the merits of the case, the writ petition, on consent, stands disposed of with the direction that in case any such representation is made within two weeks' time before the Principal DIET, Mirzapur, the same would be considered by the Authority concerned in the light of the order passed in Neeraj Kumar Rai (supra) at the earliest and in case the claim set up by the petitioner is found to be sustainable, the relevant papers may be sent to the Secretary, Examination Regulatory Authority, Allahabad, who would take a final call on the same within a period of six weeks thereafter.
