Sri Sankalp Narayan holding brief of Sri Prabhat Kumar Singh, learned counsel for the petitioner submits the petitioner was appointed in the year 2011 while the post of Hindi Lecturer fell vacant on 31.03.2018 and thus, on the date of occurrence of vacancy, the petitioner is an eligible candidate for promotion but despite representation, his promotion has not been done by the respondent No.2.

Sri Amar Nath Pandey, learned counsel for the respondent No.4 submits that the petitioner cannot be promoted on the facts of the present case. He submits that relevant facts have been suppressed in the writ petition.

Sri R.K. Mishra, learned counsel appearing on behalf of Sri Kanti Lal Yadav, who has been promoted on the post of Lecturer (Civics) and his interest is likely to be effected, states that he has filed caveat application but his caveat has not been reported. He submits that the petitioner has no right for promotion.

Considering the submissions of learned counsel for the parties, this writ petition is disposed of directing the respondent No.2 to decide the representation of the petitioner dated 28.05.2018 in accordance with law, expeditiously, preferably within three months from the date of presentation of a certified copy of this order along with a copy of the representation, after affording reasonable opportunity of hearing to all concerned including the petitioner, the respondent No.4 and Sri Kanti Lal Yadav.
