Heard Sri Nand Lal Pandey, learned counsel for the petitioner and the learned standing counsel for the State-respondents.

Submission of the learned counsel for the petitioner is that the husband of the petitioner Sri Vineet Kumar was an Assistant Teacher since 7.9.1987 in the Primary Section attached to R.P.V.M. Inter College, Syondara, District Moradabad. He died on 11.10.2016, while his retirement was due in the year 2018. Since, the husband of the petitioner died before his retirement, therefore, under Rule 5 U.P. State Aided Educational Institutions Employees Contributory Provident Fund, Insurance and Pension Rules, 1964, the petitioner is entitled for gratuity. It is further submitted that a representation in this regard has already been made before the respondent No.2, but no decision has been taken so far.

Sri S.P. Singh, learned standing counsel submits that the respondent no.2 shall decide the representation of the petitioner in accordance with law, within a time bound period and if any amount is found due and payable to the petitioner, it shall be paid to her without any delay.

In view of the aforesaid, this writ petition is disposed of giving liberty to the petitioner to make a fresh representation within two weeks from today along with a certified copy of this order raising all his grievances and in the event, such a representation is made within the stipulated period, it shall be decided by the respondent No.2 in accordance with law by a speaking and reasoned order within next eight weeks. Any amount found legally due and payable, shall be paid to the petitioner within a further period of eight weeks.

With the aforesaid directions, the writ petition is disposed of.
