Heard learned counsel for the petitioner and Sri Ram Bilas Yadav, learned counsel for the respondents.

This writ petition has been filed praying for the following relief:

"(i) a writ, order or direction in the nature of mandamus commanding the respondents to pay the arrear bill of petitioner worth Rs.32,048/- along with interest @ 18% per annum to petitioner arrear of salary of September 2008 to December, 2008 till date,

(ii) to issue a writ, order or direction in the nature of mandamus commending the respondent and directing him to decide the claim of petitioner pending before him.

(iii) to issue, any other writ, order or direction which this Hon'ble Court may deem fit and proper.

(C) to award costs of the writ petition to the petitioner."

Learned counsel for the respondents submits that the petitioner has already filed a representation raising his grievances which shall be considered by the respondent No.2 and an appropriate order in accordance with law shall be passed within a time bound period.

In view of the aforesaid, this writ petition is disposed of giving liberty to the petitioner to make a fresh representation within three weeks from today along with a certified copy of this order raising all his grievances and in the event, such a representation is made within the stipulated period, it shall be decided by the respondent No.2 in accordance with law within next six weeks. Any amount found legally due and payable, shall be paid to the petitioner within a further period of six weeks. In the event, the representation is not decided by the respondent No.2 and payment, if any, is not made to the petitioner within the stipulated period, the respondent No.2 shall be liable to pay cost to the petitioner of Rs.500/- per day for each day of delay, which shall be recoverable from his personal salary.
