Petitioner has come up before this Court with the grievance that he has secured marks above the cut-off in the respective category, but he has not been selected.

While entertaining the writ petition time was allowed to obtain instructions. Learned Standing Counsel on the basis of instructions submits that though petitioner has scored marks above the cut-off in the respective category, yet, he has not been selected as petitioner's height has been found less than the minimum prescribed for the post. Learned Standing Counsel points out that petitioner's height is 167.8 cms, whereas 168 cms. is required for the post.

Learned counsel for the petitioner has placed reliance upon a letter of the Additional Secretary of the Board dated 14.2.2018, which records that on the basis of petitioner's objection that his height has not been correctly measured, the height of petitioner has been measured again in which his height has been found to be 168 cms. The Additional Secretary in his letter has clearly directed the Nodal Officer (Recruitment) about disapproval of recommendation with regard to petitioner's height. Grievance of the petitioner is that despite all such communication, the authorities have not taken any decision in the matter.

In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.3 to issue necessary consequential directions in light of his letter dated 14.2.2017, and in accordance with law, within a period of of two months from the date of presentation of certified copy of this order. All consequential action shall be taken accordingly.
