Heard learned counsel for the parties and perused the impugned judgment and order as well as the record of the lower court.
This appeal has been preferred by appellantLakhan Singh against the judgment and order of Spl. Judge Dacoity Affected Areas, Farrukhabad dated 3.10.2001 in Special Sessions Trial No. 44 of 1988 (State of U.P. vs. Lakhan Singh) arising out of Case Crime No. 477 of 1987, Police StationGur Sahayganj, District-Farrukhabad at present District-Kannauj, convicting and sentencing the appellant under Sections-395 read with Section-397 IPC for ten years of rigorous imprisonment and coupled with a fine of Rs.10,000/- and in default of payment of fine, he will suffer three years additional rigorous imprisonment.
From the perusal of the report of the CJM- Kannauj dated 11.5.2018 which is on record of this appeal, it transpires that the sole appellant in this appeal- Lakhan Singh has died on 17.10.2009.
Learned A.G.A. has submitted that in view of report of CJM- Kannauj dated 11.5.2018, this appeal is liable to be abated.
