Challenge in this petition is made to the charge sheet no. 120 of 2021 dated 17.03.2021, summoning order dated 31.05.2021 as well as the proceedings of Criminal Case No. 3144 of 2021, State Vs. Vinod Kumar Pandey and others, under Sections, 323, 498A, 504 & 506 IPC and Section 3/4 of the Dowry Prohibition Act, 1961, pending in the court of Additional Chief Judicial Magistrate, Haldwani, District Nainital (for short, “the case”).

The petition was taken up for hearing on 27.09.2021. On that date, the petitioner no.1 and respondent no.2 were required to appear personally before the Mediation Center. Subsequently, in the mediation proceedings held with the Mediation Center of this Court, the parties entered into an amicable settlement on 03.12.2021. This is part of the record.

Today, learned counsel for the petitioners as well as the respondent no.2 would submit that since parties have agreed to withdraw cases filed by them, the petitioner may be decided in terms thereof.

Especifically, learned counsel for the respondent no.2 would submit that the respondent no.2 has agreed to withdraw all the cases filed by her.

The parties have already arrived at an amicable settlement, as recorded in the Mediation Center of this Court. This is a matrimonial discord basically. In view thereof, the matter may be decided, in terms of amicable settlement between the parties

The petition is allowed. The of charge sheet no. 120 of 2021 dated 17.03.2021, summoning order dated 31.05.2021 and proceedings of the case are hereby quashed.
