During the investigation, the petitioners were enlarged on bail for the offences punishable under Sections 109, 323, 504 & 506 IPC, but the charge sheet was submitted under Section 308 IPC also.
The court, while taking cognizance, recorded that the petitioners have to apply for bail under Section 308 IPC. It is at this stage, the petitioner approached this Court.
Heard learned counsel for the parties and perused the record.
At the very outset, learned counsel for the petitioners would submit that liberty be given to the petitioners to withdraw the petition with the direction to the Court below to consider the bail application of the petitioners, in the light of the judgment in the case of Satendra Kumar Antil Vs. Central Bureau of Investigation and another, 2021 SCC OnLine SC 922
In the case of Satendra Kumar Antil (supra), the Hon’ble Supreme Court laid down the guidelines with regard to grant of bail. The directions given by the Hon’ble Supreme Court are law of the land. This Court has no doubt, that as and when such application is moved, the court below
shall follow the command of the Hon’ble Supreme Court.
The petition is dismissed as withdrawn.
