| BA2 No.55 of 2019 Hon’ble R.C. Khulbe, J. Mr. D.K. Sharma, learned senior counsel assisted by Mr. M.K. Ray, learned counsel for the applicant. Mr. Atul Kr. Shah, learned DAG for the State. This is second bail application. The first one was decided by the Co-ordinate Bench on 20.2.2019. Accused–Abhishek Rai has sought his release on bail in connection with Case Crime/FIR No.191/2014 u/s 302/394/397/411 IPC registered at P.S. Gadarpur, District U.S. Nagar. It is the only submission by learned senior counsel that in this matter, as many as 20 witnesses have been examined; there is no chance of tampering the evidence; co-accused Golu @ Chandan Paswan has been enlarged on bail on 5.6.2021; and he also deserves bail on parity. Learned counsel for the State fairly admitted this fact. Since the co-accused has been granted bail on 5.6.2021 and the role assigned to the applicant is identical, thus, without making any comment on the merits, it is a fit case for bail at this stage on parity. The bail application is thus, allowed and the applicant is directed to be released on bail on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
