Mr. Shobhit Saharia, learned Standing Counsel for the N.C.B. Accused–Jyoti Saini has sought her release on bail in connection with Case Crime/FIR No.04/NCB/DDN/2020, U/s 8/21b, 27A, 29 of the N.D.P.S. Act, Thana N.C.B., Sub Zone Dehradun. It is argued that the accused has been falsely implicated; she is languishing in jail since 03.11.2020; there is no criminal history against her; she is ready to furnish the sureties and may be granted bail. Per contra, learned Standing Counsel for the N.C.B. opposed for bail. As per records, on 03.11.2020, a team of N.C.B. was constituted; accordingly, on secret information, the accused was apprehended and search was made; on search, 51 gram heroine was recovered from the scooty; and, the contraband article recovered does not come within the definition of commercial quantity. The accused is languishing in jail since 03.11.2020; she has no criminal history; it will take time to conclude the trial; accordingly, without making any comment on the merits, it is a fit case for bail at this stage. The bail application is thus, allowed and the applicant is directed to be released on bail on her executing personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
