Heard Mr. Deep Chandra Joshi, learned counsel for the applicant and Mr. Pratiroop Pandey, learned AGA for the State on the Time Extension Application (IA No.05 of 2022). In the present matter, i.e. in BA1 No.774 of 2021, “Anil Kumar Ojasvi vs. State of Uttarakhand”, after hearing the learned counsel for both the parties, the bail application was allowed on 03.12.2021. At the time of the hearing of the bail application, the learned counsel for the applicant had submitted that the applicant undertakes that he will deposit Rs.5,00,000/ - within two weeks’ from the date of his release on bail. At the time of the passing of the order in the said bail application, it was clarified that if the applicant misuses or violates any of the conditions, imposed upon him, or, violates his undertaking, the prosecution will be free to move the Court for cancellation of bail. The learned counsel for the applicant submitted that the applicant is facing serious financial problems and he was released on bail only on 30.03.2022, therefore, the learned counsel for the applicant requested further one week time to deposit the said amount i.e. Rs.5,00,000/ -.
