| BAI No.623 of 2021 Hon’ble R.C. Khulbe, J. Mr. R.K. Singh, learned counsel for the applicant. Mr. S.T. Bhardwaj, learned Dy.A.G. for the State. Accused–Mayank Kapoor has sought his release on bail in connection with Case Crime/FIR No.01/2021, u/s 66-D of I.T. Act 2008 and u/s 120-B, 420 IPC, registered at P.S. Cyber Crime, District Dehradun. It is argued that the accused has been falsely implicated; he is languishing in jail since 05.02.2021; there is no criminal history; there is no evidence against him; he is ready to furnish the sureties and may be granted bail. Per contra, learned counsel for the State opposed for bail. As per the FIR, it is the only allegation that the accused contacted through mobile with the informant and as per the instruction of the accused the informant transferred Rs.7 lakhs in different accounts. During the investigation call detail between the informant and the accused was obtained, which shows that the accused contacted with the informant in various times, on the basis of instruction, the informant transferred money in different accounts. Looking to the aforesaid facts, the applicant does not deserve bail at this stage. The bail application is thus, dismissed. Needless to mention that the aforesaid observations are strictly for the purposes of deciding the bail application and those shall not have any bearing on the final merits of the trial.
