Accused-Jyotiram who is in judicial custody in connection with case crime no. 173 of 2021, under Sections 452, 504, 506 and 436 IPC registered at P.S. Pathri, District Haridwar has sought his release on bail. It is argued that the applicant has falsely been implicated; he is languishing in jail since 07.06.2021; there is no evidence regarding offence punishable under section 436 IPC and is ready to furnish the sureties. Per contra, learned State Counsel opposed for bail. As per the record, the occurrence occurred on 20.05.2021; the FIR was lodged on 21.05.2021; although the accused is named in the FIR but after lodging the FIR an application was moved by one Gautam Kumar for release of the vehicle, as mentioned in the FIR in which the owner of the vehicle has clearly stated that on that day the vehicle was parked at the house of the informant Dharamveer, due to technical fault the said car was damaged by sparking, accordingly the concerned court allowed the application and released the car in favour of the registered owner; prima facie, it is clear that the car received fire due to

sparking; without making any comment
to the final merit of the case it is a fit case for bail at this stage. The bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond and furnishing two reliable sureties, in the like amount to the satisfaction of the court concerned. Pending applications, if any, also stands disposed of.
