Accused- Salman who is in judicial custody in connection with case crime no. 62 of 2021, under Sections 379 and 411 IPC registered at P.S. Selaqui District Dehradun has sought his release on bail. It is argued that the applicant has falsely been implicated; he is languishing in jail since 29.05.2021; co-accused Zulfikar Ahmed has been enlarged on bail and on the ground of parity he is also entitled for bail. Learned State Counsel fairly admitted that the co-accused has been enlarged on bail. Since, co-accused has been enlarged on bail and the role is identical, accordingly, on the ground of parity present applicant is also entitled for bail. Thus, without making any comment to the final merit of the case, it is a fit case for bail at this stage. The bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond and furnishing two reliable sureties, in the like amount to the satisfaction of the court concerned.
