Accused–Naushad has sought his release on bail in connection with Case Crime/FIR No.231 of 2019, u/s 3/5/11 of the Uttarakhand Protection for Cow Progeny Act, 2007, registered at P.S. Kotwali Gangnahar, District Haridwar. It is argued that the accused has been falsely implicated; there is no recovery against him; he has no criminal history; he is in jail since 23.2.2020; the case is triable by Magistrate; he is ready to furnish the surety; co-accused Majumml and Noor Aalam have been enlarged on bail, and the applicant deserves bail on the basis of parity. Per contra, learned counsel for the State opposed for bail but fairly submitted that co- accused have been enlarged on bail. The accused is in jail since 23.2.2020; there is no criminal history against him; co-accused have been enlarged on bail; accordingly, without going into merits of the case, it is a fit case for bail at this stage on the ground of parity. The bail application is allowed and the applicant is directed to be released on bail on his executing personal bond and furnishing two reliable sureties in the like amount, to the satisfaction of the Court concerned.
