Accused – Salman has sought his release on bail in connection with Case Crime/ FIR No.520 of 2020, u/ s 67 of the Information Technology Act & U.S 13(C) & 14 of the Protection of Children from Sexual Offences Act, 2012, registered at P.S. Laksar, District-Haridwar. It is argued that the accused has been falsely implicated; there was previous enmity between family of the accused and the informant; there is no allegation regarding sexual offence; he is languishing in jail since 28.07.2020; there is no criminal history against him; he is ready to furnish the sureties; and he may be granted bail. Per contra, learned counsel for the State although opposed for bail but no counter affidavit has been filed by the State till yet. criminal history; it is only allegation that the accused misused the photograph of
the minor girl; it is a matter of evidence whether photograph of the minor girl was actually misused through facebook or not; it will take time to conclude the trial, accordingly, without going into merits of the case, it is a fit case for bail at this stage. Accordingly, the present bail application is allowed and the applicant is
directed to be released on bail on his executing personal bond and furnishing two reliable sureties in the like amount,
to the satisfaction of the Court
concerned. Pending application, if any, stands disposed of.
