Ms. Manisha Rana Singh, learned A.G.A. along with Ms. Sonika Khulbe, learned B.H. for the State. Accused–Naeem and Meharban @ Bhutto @ Buda have sought their release on bail in connection with Case Crime/FIR No.515/2021 u/s 380, 411 IPC, registered at P.S. Kotwali Civil Line, Roorkee, District Haridwar. It is argued that the accused have been falsely implicated; they are languishing in jail since 18.09.2021; co-accused Bundu has been enlarged on bail by this Court vide order dated 05.10.2021; they are ready to furnish the sureties and may be granted bail on parity. Per contra, learned counsel for the State opposed for bail but fairly admitted the above facts. The accused are languishing in jail since 18.09.2021; they are not named in the FIR; co- accused Bundu has already been enlarged on bail; the role is identical; accordingly, without making any comment on the merits, it is a fit case for bail at this stage on parity. The bail application is thus, allowed and the applicants are directed to be released on bail on the ground of parity on executing one personal bond and furnishing two reliable sureties by each one of them in the like amount, to the satisfaction of the Court concerned.
