The appellant had filed a complaint which was dismissed on 07.07.2007 in non prosecution. This order is challenged in the instant appeal.
Today, learned counsel for the appellant would submit that the appellant has died and nobody has further come to prosecute the appeal.
In view of the statement made by learned counsel for the appellant and since the appellant has died, nothing survives and the appeal stands disposed of accordingly.
