This is defendants’ petition against the orders dated 31.05.2016 and 05.03.2016 passed by learned appellate court and learned trial court, respectively.

Learned trial court had allowed plaintiff’s/respondent’s temporary injunction application under Order 39 Rule 1 & 2 of C.P.C. and learned 3^rd Additional District Judge, Haridwar dismissed the miscellaneous appeal filed by the defendant/petitioner vide judgment and order dated 31.05.2016.

Learned counsels for the respondent submit that Original Suit No. 31 of 2016 has been decreed vide judgment and order dated 22.01.2019 in terms of the compromise arrived at between the parties. Thus, according to learned counsels for the respondents, this writ petition, which arises out of the order passed on temporary injunction application, has now become infructuous. A copy of the order dated 22.01.2019 passed by 1^st Additional Civil Judge (S.D.), Haridwar, on the compromise application filed by the parties, is on record as annexure No. 2 to the affidavit dated 30.05.2019 filed in support of urgency application.

Having regard to the aforesaid facts and circumstances of the case, writ petition has become infructuous and is dismissed as such.
