WPSB No. 394 of 2011 filed by the applicant was disposed of by Division Bench of this Court vide order dated 01.11.2018 with a direction to the respondents to consider the case of the petitioner as per the law laid down by Hon’ble Supreme Court in Civil Appeal No. 6491-6492 of 2014 in the case of Coal India Ltd. & another Vs. Navin Kumar Singh.
This contempt application has been filed alleging willful disobedience of the said order.
Mr. Vinay Kumar, learned counsel for opposite parties submits that order passed by Division Bench of this Court has been complied with. He refers to the order dated 12.02.2019 passed by Director, Human Resource, Uttarakhand Jal Vidiyut Nigam Ltd.
A perusal of the said order reveals that claim of the applicant was considered by the Director, Human Resource in terms of judgment rendered by Hon’ble Supreme Court in Civil Appeal No. 64916492 of 2014 in the case of Coal India Ltd. & another Vs. Navin Kumar Singh.
Thus, the order passed by Writ Court stands complied with.
Accordingly the contempt petition is dismissed. Contempt notice issued against opposite parties are hereby discharged.
