“That at the outset it is most respectfully submitted that in compliance of the judgment and order dated 24.07.2014 passed in special appeal no. 271 of 2011 Bahadur Singh and others Vs. Anusuya Lal and others, a departmental promotion committee was constituted on 24.12.2014 for filing up the vacant post by promotion under the promotional quota and as per the recommendation of the departmental promotion committee, 32 employees were promoted to the subordinate services cadre-3 in the payband of Rs. 5200-2000 + grade Rs. 2000/- in compliance of the aforesaid judgment and order dated 24.07.2014, the petitioners who were covered by the judgment in the judgment in the aforesaid appeal, have been granted notional promotion from the date of their promotion i.e. 31.03.2010 and similarly, the respondent no. 3 Sri Purnanand Nautiyal S/o late Shri Shri Dutt Nautiyal has also been granted notional promotion w.e.f. 31.03.2010. It is further submitted that the case of another respondent i.e. respondent and respondent no. 2 Shri Kuldeep Singh S/o Shri Balwnt Singh and respondent no. 5 Vikram Singh S/o Shri bangi Lal was also considered by the departmental promotion committee, but as per the seniority list of Mali cadre in the department, the aforesaid employees are at serial no. 775, 778 and 784 respectively, as such, they were not eligible for being promoted, since they were below in seniority list and in the promotional quota the vacant 32 posts of the Mali cadre were filled up to serial no. 427 of the seniority list and the employees up till 427 of the seniority list, who were High School pass or holding equivalent certificates recognized by the State were considered to be fit for the aforesaid promotion. A true copy of the promotion orders are being filed herewith and marked as Annexure No. 1, 2 and 3 respectively.”
