The petitioner by means of the present writ petition sought his promotion to the post of Supervisor Kanoongo, which is also known as “Revenue Inspector” in the State of Uttarakhand. However, during the pendency of the writ petition on 12th September, 2013 the Commissioner and the Secretary of the Revenue Department has already considering the seniority of the petitioner from 01.01.1977 passed an order that the petitioner will be sent for training of Revenue Inspector.
In view thereof, the learned counsel for the petitioner seeks to withdraw the writ petition.
Accordingly, the writ petition is dismissed as withdrawn. It is, however, made clear that merely the writ petition has been withdrawn will not prejudice the case of the petitioner in any manner.
