Delay condonation application (CLMA No. 12399 of 2014) in filing counter affidavit is allowed. The delay in filing the counter affidavit is hereby condoned.
Counter affidavit filed on behalf of respondent no. 5 is taken on record. Heard learned counsel for the parties on the writ petition.
The father of the petitioner died in harness on 31.01.2012 while working as Beldar in Public Works Department. The fact that he was working on the regular post is not in dispute. However, the petitioner’s appointment on compassionate ground in Public Works Department though is under consideration but no decision has been taken as yet.
Now the counter affidavit has been filed by the State stating that the appointment of the petitioner on compassionate ground is under consideration. Nothing more needs to be stated.
In view thereof, the writ petition is disposed of with the direction to the State authorities to take a decision in the matter in accordance with law.
No order as to costs.
