The petitioner/plaintiff had filed a suit for rent and ejectment being S.C.C. Suit No. 22 of 2010 before the Civil Judge (S.D.), Roorkee, District Haridwar against the respondent tenant. The said suit is still pending before the court concerned. According to the petitioner, the evidence of the plaintiff is concluded on 12.12.2012. Thereafter, the respondent tenant is adopting one dilatory method after another in order to delay the proceedings.

The petitioner is 72 years landlady and prays for expeditious disposal of her case. This Court is of the opinion that such matters must be expedited without any further delay, and particularly, keeping in mind the fact that the order for expeditious disposal of the matter is not an adverse consequence to the tenant/respondent.

In view of the above fact, the writ petition is disposed of with a direction to the JSCC/Civil Judge (S.D.), Roorkee, District Haridwar, where the matter is pending, to dispose of the matter without granting any unnecessary adjournment to any of the parties. Let the matter be disposed of within six months from the date of production of a certified copy of this order.
