The petitioner is a Lecturer in Government Girls Inter College, Banbhulpura, Nainital and she is aggrieved by transfer order dated 12.12.2011 though by this order she has actually been promoted as Principal, Government Girls High School, Dungrai at Pauri Garhwal.

She is aggrieved by the said transfer order on two grounds firstly, according to her she has a Autistic girl child of 13 years of age which needs to be looked after and secondly, her husband is a Assistant Professor in Government College, Kotabagh, District Nainital, and under the policy of the Government, as far as possible, the husband and the wife should be posted at the same place. On these grounds she challenges the transfer order before this Court.

Heard Mr. Sandeep Tiwari, learned counsel for the petitioner, Mr. Vikas Pandey, learned Brief Holder for the State and perused the record.

Looking at the condition of the petitioner, the writ petition is disposed of with a direction to the Director, Uttarakhand Secondary School Education to decide the

representation dated 01.12.2013 of the petitioner, considering the case of the petitioner sympathetically and make efforts to adjust the petitioner in a nearby area or district.

It is made clear till the disposal of such representation, the operation and effect of the transfer order, as far as it relates to the petitioner, shall remain stayed. No order as to costs.
