Applicant, who is in jail in connection with R.C. no. 0072014A007, under Sections 7/13(2)/13(1)(D) of the Prevention of Corruption Act, 1988, registered at police station, Vigilance Sector, S.P.I. Dehradun, has sought his release on bail.
Heard learned counsel for the parties, perused the material on record and considered the grounds taken up in the bail application.
Counter affidavit filed by respondent CBI is taken on record. Misc. Application no. 4801 of 2014 made therefor is disposed of.
Applicant was caught red handed taking illegal gratification of Rs. 20,000/- from the complainant for processing the retirement benefit file of his father. Applicant called the complainant in his office for handing over the bribe money. It is also the allegation against the applicant that he is habitual of demanding and accepting bribe. In such a situation, it is not a case of grant of bail.
Bail application is accordingly dismissed.
