Applicant, who is in jail in connection with case crime no. 227 of 2014, under Section 3/5/11 of the Uttarakhand Protection of Cow Progeny Act and Sections 323, 504, 506, 353, 332 IPC, registered at police station, Ranipur, District Haridwar, has sought his release on bail.
Heard learned counsel for the parties, perused the material on record and considered the grounds taken up in the bail application.
An FIR was lodged against the applicant and other accused persons in connection with the offences punishable under Section 3/5/11 of the Uttarakhand Protection of Cow Progeny Act and Sections 323, 504, 506, 353, 332 IPC, alleging therein that when the police party tried to stop the accused persons, they hurled abuses at them, pushed them aside and fled away. The applicant is in jail since 11.09.2014 and has no previous criminal history.
Considering all the facts and circumstances, a case for bail is made out.
Bail application is allowed.
Let the applicant be released on bail on his executing a personal bond and furnishing two sureties, each of like amount, to the satisfaction of CJM, Haridwar.
