Heard Mr. A. Nadni, the learned counsel for the

petitioner.

The grievance of the petitioner is directed against the order dated 02-05-2017 passed by the learned District Judge, Dharmanagar, North Tripura in Commercial Suit No.01/2016 whereby no decision was taken by him as to whether the documents produced by the petitioner are to be exhibited or not. The learned District Judge, Dharmanagar, North Tripura without taking a decision merely ordered that the documents should be kept with the case records. The documents sought to be exhibited were submitted by the learned counsel for the petitioner on 28-03-2017. In my opinion, there is failure to exercise jurisdiction by the learned District Judge in not taking a decision either way.

This revision petition is disposed of by directing the learned District Judge, Dharmanagar, North Tripura to take a decision as to whether the documents are to be exhibited or not in accordance with law without unnecessary delay.
