Heard Mr. B.N. Majumder, the learned counsel for the applicant. Also heard Mr. S. Sarkar, the learned Public Prosecutor appearing for the State.
This is an application under Section 438 Cr.P.C. for granting pre-arrest bail to the applicant namely, Rajesh Debnath, who apprehends that he would be arrested by police in connection with Melaghar P.S. Case No.23 of 2017 under Section 376 IPC.
With the assistance of the learned Public Prosecutor, I have gone through the Case Diary produced by him and other materials on record. After giving my anxious consideration to the materials available on record, I am of the view that this is not a fit case for custodial interrogation of the applicant.
