This writ petition is {iled declaring the action of the respondents in not considering the application for Appeals on Demarcation, dated 21 .11.2025 and non-conducting the survey and demarcation of the petitioner's agricultural land admeasuring Acs.2.25 guntas in Sy.No.413/UU situated at Lemoor Village, Kandukur Mandal, Ranga Reddy District, as illegal, arbitrar5r and violative of the principles of natural justice and consequently, prayed for other appropriate reliefs.

Government Pleader for Revenue appea.ring for the respondents and with their consent, this writ^{petition is} being taken up for disposal at the admission stage.

Learned counsel for the petitioner would submit that the petitioner is the owner and possessor of the aforesaid agricultural land having purchased the same through registered sale deed bearing document No.1 1334 of 2014., dated 2i.08.2024 and his name is recorded as pattadar in all the revenue records and the revenue authorities also issued e-pattadar passbook bearing No.T05l lOl2O929 uide Khata No.1494 in his favour under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2O2O. Learned counsel for the petitioner would further submit that, in order to protect the land from the land grabbers, the petitioner has submitted an application for Appeals on Demarcation, dated 2l .17.2025 to respondent No.3, by paying requisite fee for conducting survey of the subject lald and to fix the boundaries. The grievance of the petitioner IS that, even after receipt of the said application the respondent authorities did not conduct

survey and fix the boundaries. Learned counsel for the , petitioner would further submit that in terms of the circula-rs issued by the Commissioner, Survey, Settlements and Land Records, the respondents a-re bound to consider the application within 45 days from the date of the application after collecting necessary charges.

Learned Assistant Government Pleader for Revenue appearing for the respondents has submitted that the petitioner Iiled the application lor appeals on demarcation against the panchanama in R.No.G8/IBO4/87 and if the said application is under limitation the respondent authorities would consider the same by foilowing due procedure laid down under law and conduct survey ald demarcate the subject land by hxing boundaries.

It is settled law that the Survey Department has the authority to conduct survey and demarcate lands in accordance with the provisions of the Telangana Land Revenue Act, 1317 Fasli (Act No. VIII of 1317 Fasli), the Telalgala Survey and Boundaries Act, 1923, and the Rules framed thereunder. The Government has issued

various circulars specifying the conditions for conducting surveys, particularly F-Line (field measurement)^surveys. Individuals requesting such surveys are required to submit specific documents, and if the conditions stipulated in the circulars are fulfi1led, the survey and boundary fixation may be conclucted. The Commissioner, Survey, Settlements and Land Records, exercising powers under the Telangana Survey and Boundaries Act, 1923, issued relevant circulars from time to time vide Rc.No.Nl/6543199, dated 25.O7,2OO1. Rc.No.N1/1408/07, dated 13.07.2OO7, and Rc.No.N2/174112O1O, dated 18.05.2010 stipulating the conditions for conducting survey of private lands and as per the said circulars, if the petitioner fulfils all the conditions of the said circular, it is an obligation for the respondents to conduct survey within the time specified in the said circulars.

In view of the a-foresaid discussion, this Court deems it appropriate to dispose of this writ petition directing respondent No.3 to exarnine the petitioner's application for appeals on demarcation uide No.AOD022500075866, dated

21.lL.2025 submitted for conducting survey and demarcation by fixing boundar5r stones to the aforesaid land duly taking into consideration of the iimitation also and if the petitioner fulfils all the conditions mentioned in the circulars issued by the Commissioner, Survey, Settlements and Land Records from time to time, after issuing notices to all the persons interested and adjacent pattadars and after considering their objections, respondent No.3 shall conduct survey of the aforesaid land in accordance with the provisions of the Telangana Survey and Boundaries Act, 1923, as expeditiously as possible.

7 . With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
