ORDER:

The petitioner submitted an Online Application vide Application Reference No.25- I 055 84221 4 dated 05.07 .2025 seeking re-issue/renewal of Passport bearing No.Y7376868, however, the respondent-passport authority has refused to renew the passport on the ground that the petitioner is facing criminal proceedings in C.C.No.165 of 2021 on the file of III Additional Judicial Magistrate of First Class, at Mahabubnagaq for the offences punishable under Sections 323, 427 ,506 read with 34 of IPC and Section 3 of the Prevention of Damage to Public Property Act.

Heard Mr. L. Harish, leamed counsel for the petitioner; and Sri V.T.Kalyan, ldamed Standing Counsel for the Central Govemment. None appeared for respondent No.3, though notice was served. Perused the record.

At the hearing, both the leamed counsel submit that the present writ petition is covered by the Order dated 03.09.2025 passed by this Court in W.P.No.24690 of 2025. ----

Considering the respective submissions, this C I rrt directs the 2nd respondent-passport^authority to consider the Online Apyr Lcation filed by the petitioner on^{the following} conditions:

i) The petitioner herein shall submit an undertakirg along with an affidavit in C.C. No.165 of 2021, pending on the file of lllArj itional Judicial Magistrate of First Class, at Mahabubnagar, stating that ho rhall not leave lndia during pendency of the said C_C., without permission c the Court and that he shall cooperate with trial Court in concluding the prr: eedings in the said C.C.;

ii) On filing such an undertaking as well as affidav t the trial Court shall issue a certified copy of the same within two (2) weekr; herefrom;

iii) The petitioner herein shall submit an application zLf esh along with certified copy of thrs order as well as the aforesaid underttrl ing before the Passport Officer / Authority concerned for renewal of passpc t;

iv) On filing such an application, the^passport Officer , Authority shall consider the same afresh in the light of the observations mac .' by this Court herein as well as the contents of the undertaking given by^- ) petitioner for issuance of renewed passpo(, in accordance with law vvi rin three (03) weeks from the date of said application;

v) Respondent No.2 shall consider Rule 12 of the ) rssport Rules, 1967 while considering the aforesaid application submitted t1 the petitioner;

vi) On issuance ofthe renewed^passport, the petiticr :r herein shall deposit the same before the trial Court in C.C. No.165 of 20: 1 , pending on the file of lllAdditional Judicial Magistrate of First Class, at tV )habubnagar;
