The Section 71 of the Act, 1908, reads as follows:

Reasons for refusal to register to be recr,r fed.-

(1 ) Every Sub-Registrar refusing LC regrster a document, except on the ground that tht property to which it relates is not situated wittr: 'r his subdistrict shall make an order of refusal I rd recorded his reasons for such order in his Bor,l No.2, and endorse the words "registration refus 'd" on t he document; and, on application made b r any person executing or claiming under the docr r rent, shal[, without payment and unnecessary delav give him a copy of the reasons so recorded.

(2) No registering ollicer shall accept fo:' rcgrstration a document so endorsed unless and unr i , under the provisions hereinafter s6ntained, the I rcumcnt is directed to be registered.

In view of the above made submissi,r ts coupled with the provision under Section 71 of the Ac1 1908, this writ petition is disposed of directing the Registcr ing Authority to receive, register and release the sut iect document presented by the petitioner uide Slot Booking

No.25O0599696 dated 28.08.2025 in respect^{of the subject} property, subject to the petitioner complying with the provisions of the Act, 1908 as well as the Indian Stamp^Act, 1899. It will be open to the Registering Authorit5r to^refuse the document presented before him, it he has any objection, by duly assigning reasons in support of such^{decision and} communicate the said decision to the^{petitioner. It is made} clear that this Court has not expressed^{any opinionon} merits of the case as to the entitlement^{of the petitionerto} get the subject document registered. There shall be^no order as to costs.
