4 The Section^{71 of the Act, 19O8, reads as follows:}

Reasons^{for refusal to register to be recorded'-}

(1) Every^{Sub-Registrarrefusing toregister a} document,^{excepton the ground that the propertyto} which it^{relates is not situated within his sub-} district shall^{makean orderof refusalhnd recorded} his reasons^{for such order in his Book No'2; and} endorse the^{words "registrationrefused' on the} document;^{and, on applicationmade by arry person} executing^{or claimingunder the document' shall'} without^{paymentand unnecessarydelay'give him a} copy of^{the reasonsso recorded'}

The Section 71 of the Act, 19O8, readr; as follows:

Reasons for refusal to register to be recor [ed.-

¶38

(1) Every Sub-Registrar refusing to register a document, except on the ground that th: property to which it relates is not situated withi r his subdistrict shall make an order of refusal zLr Ld recorded his reasons for such order in his Bool No.2, and endorse the words 'registration refur;r d" on the docurnent; and, on application made b1' any person executing or claiming under the docur rent, sha1l, without payrnent and unnecessary dela., give him a copy of the reasons so recorded.

(2) No registering officer shall accept foregistration a document so endorsed unless and unti , under the provisions hereinafter contained, the rl rcument is directed to be registered.

It will be open to the Registering Authority to refuse the document presented before him, if he has any objection, by duly assigning reasons in support of such decision and communicate the said decision to the petitioner. It is made clear that ttris Court has not expressed any opinion on merits of the case as to the entitlement of tle petitioner to get the subject document registered. There shall be no order as to costs.
